FDHRD issues its report on the application of the new traffic law in the Egyptian streets
Today on 21/10/2008, FDHRD is issuing its report on the new traffic law entitled “ the application of the new traffic law in the Egyptian streets”. This report is done under the works of the media and local citizens program that aims at monitoring cases and problems of society . This report shows a real picture of the nature of the Egyptian street after the application of the traffic law. This report deals with three issues which are the legislative amendments that has been inserted in the Egyptian traffic law on 266 of 1973, the analysis of the contents of the Egyptian newspapers that approached the new Egyptian traffic law through the analysis of the contents of 17 Egyptian newspapers during the period from 1/6/2008 and 12/10/2008, and it includes a field survey on South Cairo and North Helwan areas in order to highlight the real picture of the Egyptian street two months after the application of the new Egyptian law.
The report reached the following observations:
1- The new Egyptian traffic law solves the problem of the Tocktock ( small three wheeled cars) :
The Egyptian legislator responded to the requests of experts and law professors as the new traffic law permitted for issuing licenses for tocktocks and the law considered them as motorcycles . The law permitted for issuing licenses for those tocktocks in order to avoid a lot of legal problems that appeared recently due to the denial of recognizing and giving permission to tocktocks. Such problems resulted from the occurrence of a lot of car accidents and the perpetrators could not be recognized due to the lack of information on the owners of the tocktocks.
2- Canceling giving driving licenses for three months in case of changing routes without taking permissions for the microbuses and other kinds of carrying passengers cars:
According to the last amendments in the traffic law, the penalty for changing the travel route of carrying passengers cars is the withdrawal of the licenses for not less than a month and for not more than three months. In addition, according to the amendments , the same penalty is applicable for cars carrying passengers from outside the stations. However , the penalty was the withdrawal of the license for 60 days only before the amendments for changing the travel route.
3- Issuing imprisonment sentences in case of repeating the same breaches:
The Egyptian legislator did another amendment to the traffic law which is giving imprisonment sentences which is not a positive amendments as this law gives some penalties that ranges from 6 months imprisonments sentences and a fine not less than 300 L.E and not more than 1500 L.E for those who commit breaches due to article 70 of the traffic law. In this regard, article 70 of this law which is amended due to law no. 121 of 2008 states that the driver who refuses to carry passengers without any reasons or refuses to use the fare and distance counter or requests a fare more than the due fare or carries number of passengers more than the maximum number of passengers that his/her car can carry or carries passengers from outside the stations allocated for taxes that work without counters, shall be penalized with a fine ranging from 300 L.E to 1500 L.E . Therefore, in the case of carrying a number of passengers more than the seats of the car , this driver can be imprisoned for 6 months and pay a fine of 3000 L.E

The Egyptian media did not do awareness for citizens on this law and it only focused on the reflection tingle and first aid bag. In this regard, it did not aware citizens of the amended articles of the law, the rights of citizens and the negatives parts of the legislation.
5- National newspapers are the top newspapers that approached the new traffic law:
National newspapers talked about the new law as there were 507 journalistic articles on the new traffic law while private newspaper published 425 journalistic articles on this law while the political parties’ newspapers published 222 articles on this law.
6- Al Akhbar newspaper is the top national newspaper in publishing articles on the new traffic law :
Al Akhbar newspaper is the top newspaper in publishing articles on the new traffic law as it published 149 articles on this law while Al Ahram newspaper came at the second top and then came El Wafd newspaper on the third top as it published 109 journalistic articles on this law.
7- Al Masry El Youm “ Egypt Today” newspaper is the top private newspaper that published articles and news on the traffic law as it published 95 news and articles on this law:
Al Masry El Youm “ Egypt Today” newspaper is the top private newspaper that published articles and news on the traffic law as it published 95 news and articles on this law. Then, El Dostor newspaper published 92 articles and news on this law while El Nahda newspaper published 75 articles and news on this law and then came Sout El Omah , El FAgr and Al Asbou’o newspapers came at the last tops among the independent newspaper.
8- El Wafd came at the top among the political parties’ newspaper in publishing articles and news on this law:
El Wafd came at the top among the political parties’ newspaper in publishing articles and news on this law as it published 109 articles and news on this law. Then, El Ahrar newspaper came at the second top as it published 79 articles and news on this law while Al Ahly newspaper came at the third top as it published 15 articles on this law while El Karam newspaper published 11 articles while El Arabi newspaper published 8 articles.
9- Dar El Salam, Rokn El Farouk , Mist Helwan El Zera’I are the most areas where there occurrence of a lot of traffic breaches that threaten the lives of people:
Dar El Salam, Rokn El Farouk , Mist Helwan El Zera’I area in South Cairo Areas and North Helwan area are the most areas where there are occurrence of a lot of traffic breaches that threaten the lives of people. The occurrence of traffic breaches take place there due to the lack of the security existence or due to the bad behaviors of citizens , drivers, owners of workshops and shops.
Also, there are a lot of breaches done by the owners of private shops in Dar El Salam area as they take part of the pavements and streets to put and sell their goods which hinder the traffic process. Most of these shops that did such breaches are located in Abi Ashraf areas and at the entrance of Dar El Salam Bridge and behind Dar El Salam area. In addition, there are a lot of messes in the buss and microbus stations that are located in Dar El Salam and that are going to El Sayeda Eisha area as well as the owners of the shops and cafes are using streets for their own benefits. Besides, in the area of El Tarawat, the sellers and the owners of workshops are using streets which lead to the blocking of traffic process and also there are a lot of messes in Rokn El Farouk and Misr Hilwan agricultural streets. There are also traffic messes at the junction at EL Neel street with the military forces hospital in El Maadi and this mess is extended till the Military Works Club in Torah area.
This report recommends the following recommendations:
- The Egyptian civil society shall play a role in doing awareness for citizens on their rights as they shall know more information on the last legislative amendments done in the Egyptian laws. In this regards, civil society associations shall do awareness in their geographical areas on the amendments of the traffic law and explaining the rights and duties of citizens.
- Media shall do a positive role in disseminating the traffic culture.
- The traffic men and traffic police shall exist in all streets and public squares particularly in side streets where there are a lot of traffic messes due to the lack of security existence.
